Estate Administration

At Schroon Law, we understand that the loss of a loved one brings emotional and logistical challenges. Our Estate Administration services are designed to guide individuals and families through the legal steps that follow a death—whether that involves probate, trust administration, or other Surrogate’s Court proceedings.

Estate administration refers to the process of settling a person’s affairs after they pass away. This may involve proving a will in court, appointing a personal representative, distributing assets, paying debts and taxes, and ensuring the decedent’s wishes—or New York’s default rules—are properly followed.

We work with executors, administrators, and trustees to ensure their duties are carried out properly and efficiently. Our services include:

  • Probate Proceedings:  When there is a will, we guide clients through the court-supervised process of proving the will’s validity, appointing an executor, and administering the estate.

  • Administration Proceedings:  When there is no will, we assist family members in petitioning Surrogate’s Court to appoint an administrator and distribute assets according to New York’s laws of intestacy.

  • Trust Administration:  We advise trustees on managing trust assets, making distributions, and complying with their fiduciary obligations.

  • Ancillary Proceedings:  We represent out-of-state estates that need to transfer or sell real property located in New York through ancillary probate or administration.

  • Asset Distribution:  We coordinate the legal transfer of real estate, bank accounts, investments, and personal property to the appropriate heirs or beneficiaries.

  • Creditor Claims and Debts:   We assist in identifying, reviewing, and resolving debts or claims against the estate in accordance with state law.

  • Estate Tax Filings and Legal Notices:  We help ensure that all necessary filings with the IRS, New York State, and Surrogate’s Court are completed accurately and on time.

Whether your loved one left a detailed estate plan or passed away without a will, we are here to make the process as smooth and manageable as possible. Every estate is unique, and we take the time to understand your family’s specific situation, provide clear guidance, and handle the legal complexities with care.

If you’ve been named an executor, trustee, or administrator—or if you’re unsure where to begin—contact Schroon Law for trusted support and experienced counsel every step of the way.
